Welcome to Patriot LLC (“Company,” “we,” “our,” or “us”). By accessing our website or requesting our heavy equipment services, you agree to the following Terms of Service (“Terms”).
1. Services Provided
Patriot LLC provides mobile diagnostics, repair, maintenance, and inspection services for heavy equipment and machinery. All services are subject to availability and may be refused at our discretion.
2. Scheduling & Service Calls
Service requests submitted through the website are not guaranteed appointments. Arrival times for our heavy equipment services are estimates and may change due to workload, travel, weather, or prior job delays. The customer agrees to provide safe and reasonable access to equipment.
Service Call / Trip Charge
A service call fee (trip charge) may apply to all on-site visits, regardless of whether repairs are completed. This fee covers travel time, fuel, and initial evaluation.
3. Estimates & Authorization
Estimates for repair and maintenance are based on initial inspection and are subject to change. Additional issues discovered during service may require further approval. By approving service, the customer authorizes Patriot LLC to perform agreed-upon work and incur related charges.
4. Payment Terms
Payment is due immediately upon completion of service unless otherwise agreed in writing. We reserve the right to require deposits for large or special-order jobs. Late payments may incur interest at the maximum rate allowed under Tennessee law.
Collection & Recovery Costs
The customer agrees to pay all costs associated with the collection of unpaid invoices, including attorney fees, court costs, and collection agency fees.
5. Mechanic’s Lien Rights
Patriot LLC reserves all rights under applicable Tennessee law to file a mechanic’s or materialman’s lien against equipment or property for unpaid services, labor, or materials.
6. Abandoned Equipment
Any equipment left unpaid or unclaimed for more than 30 days after service completion may be considered abandoned. Patriot LLC reserves the right to charge storage fees, take possession as allowed by law, and sell or dispose of equipment to recover unpaid balances, where legally permitted.
7. Customer Responsibilities
The customer agrees to provide accurate information about equipment condition, disclose known issues or prior repairs, and ensure a safe working environment. We reserve the right to refuse or stop work if conditions are unsafe.
8. Repairs & No Guarantee of Outcome
We do not guarantee that all issues will be fully resolved. Equipment failures may occur due to age, wear, or pre-existing conditions. Repairs may reveal additional problems not initially visible.
9. Warranty Disclaimer
All services are provided “as is” unless a written warranty is explicitly provided. Patriot LLC disclaims all implied warranties, including merchantability and fitness for a particular purpose. If a warranty is provided, it will be limited strictly to the terms stated in writing.
10. Inspection Disclaimer
All inspections are limited visual and functional assessments only. We do not guarantee identification of all defects, future performance or reliability, or suitability for purchase or operation. Inspection results are for informational purposes only.
11. Limitation of Liability
To the fullest extent permitted by Tennessee law, Patriot LLC shall not be liable for equipment downtime, loss of revenue or business, or indirect, incidental, or consequential damages. Total liability shall not exceed the amount paid for the specific service performed.
12. Field Service Risks
The customer acknowledges risks associated with on-site repair and maintenance, including environmental and jobsite hazards. Patriot LLC is not responsible for delays or damages caused by such conditions.
13. Website Use
You agree not to use the website unlawfully, attempt unauthorized access, or disrupt functionality.
14. Intellectual Property
All website content is the property of Patriot LLC and may not be used without permission.
15. Termination
We reserve the right to refuse service or terminate access at any time.
16. Governing Law
These Terms are governed by the laws of the State of Tennessee.
17. Changes to Terms
We may update these Terms at any time. Continued use of our website or services constitutes acceptance.
